Aaitra – Privacy Policy This Privacy Policy describes the types of information that Collabrix HR Private Limited collects from you when you access our Website, the Aaitra mobile application and other online services (“Our Services”). This policy applies only to information we collect through Our Services, in email, text and other electronic communications sent through or in connection with our Services.

Collabrix HR Pvt. Ltd. (hereinafter referred to as "us," "we,", "our", “Company”) values and respects your privacy. Collabrix HR Pvt. Ltd. is committed to respecting your privacy and complying with applicable data protection and privacy laws i.e. the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011. We have taken our best efforts to ensure protection of your data. We have provided this Privacy Policy to help you understand how we collect, use, and protect your information. We wish to help you make informed decisions; therefore, please take a few moments to read the sections below and learn how we may use your information.   1. 1. Definitions
    • 1.1. Personal Information shall mean information that can be used to personally identify a User, more fully described in Clause 2.1 to 2.3.
    • 1.2. Information shall mean Personal and Non-Personal Information.
    • 1.3. Non-Personal Information shall mean Information that cannot be used to personal identify a user.
    • 1.4. Our Services shall mean the Aaitra Mobile Application available for download on the Apple App Store, Google Play Store and other platforms as made available from time to time and the website located at [x].
    • 1.5. Terms and Conditions shall mean the Terms and Conditions that govern a User’s use of Our Services, available here.
    • 1.6. Aaitra or App shall mean a mobile application available for download on the Apple App Store, Google Play Store and other platforms as may be available from time to time.
    • 1.7. ‘Collabrix’ shall refer to Collabrix HR Private Limited, a private company limited by shares, incorporated under the Companies Act, 2013.
    • 1.8. ‘Candidate’ shall mean a person who:
      • 1.8.1. Is seeking a job;
      • 1.8.2. Creates an account on Our Services and;
      • 1.8.3. Pays the Registration Fee
    • 1.9. Employer shall mean an Organisation or Individual who is desirous of hiring Candidates in order to fill up job vacancies. The Organisation or Individual may post job vacancies on Our Services in this regard.
    • 1.10. Fee shall mean a payment that has to be made by a User to avail of Credits to use Our Service.
    • 1.11. Individual shall refer to an entity, or a person that has not been formally incorporated and is desirous of hiring a Candidate or Candidates on the basis of the job vacancy or vacancies posted on the App.
    • 1.12. Organisation shall refer to an entity that has been formally incorporated and registered as a Partnership (as per the Indian Partnership Act, 1932), a LLP (as per the Limited Liability Partnership Act, 2008), or either a Private or a Public Company (as per the Companies Act, 2013).
    • 1.13. Sourcing Platform shall mean a platform that matches a Candidate’s profile uploaded on the Aaitra App to a job vacancy posted by an Employer.
    • 1.14. Terms shall mean these Terms and Conditions drafted by Collabrix HR Pvt. Ltd. that govern the use of the Aaitra App.
    • 1.15. User shall refer to both an Employer and a Candidate in a general sense.
    • 1.16. Website shall refer to www.aaitra.com
    • 1.17. You shall refer to both an Employer and a Candidate in a general sense
    • 1.18. Your Information shall refer to Information received from a User.
  2. 2. Collection and use of Information:
    • 2.1. Information collected from a User (Personal Information):
      • 2.1.1. You may give us information about yourself during the time of creating an account on our Services or by corresponding with us by phone, e-mail or otherwise.
    • 2.2. Personal Information from Candidates:
      • 2.2.1. To create an account, you must give us information about your name, include name, mobile number, email ID.
      • 2.2.2. Profile-related information: While building a profile on Our Services, you share the following information about yourself: Photograph, Relevant industry, Job function, Qualifications, if any; Duration of latest education; Work experience; Current salary; Notice period; Preferred work location; Skills.
      • 2.2.3. Uploading of documents: Scan of Aadhar Card. In this regard, Collabrix will ensure that it’s treatment and use of the Aadhar Number is per the Aadhar Act, 2016.
    • 2.3. Personal Information collected from Employers:
      • 2.3.1. To create an account, you must give us information regarding your Contact Person, i.e., his/her name, mobile number and email ID. Furthermore, depending on whether you are an Organisation or Individual, you give us details about your PAN, TAN, Certificate of Incorporation and/or other documents that evidence formal incorporation with relevant government authorities.
      • 2.3.2. While posting a job vacancy on Our Services, you share the following information: Job sector, role, title, experience level, number of vacancies, notice period, salary, location.
    • 2.4. Information we receive from other sources.
      • 2.4.1. We work closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, assessment centres, etc.) and may receive information about you from them.
    • 2.5. Information we collect about you during your use of Our Services (Non-personal information):
      • 2.5.1. technical information, including the Internet protocol (IP) address used to connect your computer to the Internet, your login information, browser type and version, time zone setting, location, browser plug-in types and versions, operating system and platform;
      • 2.5.2. information about your visit, including the full Uniform Resource Locators (URL) clickstream to, through and from our site (including date and time); products you viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page and any phone number used to call our customer service number.
  3. 3. How does the application use the collected data?
    • 3.1. Information Collected from a User (Personal Information)
      • 3.1.1. To carry out our role: Aaitra is a Sourcing Platform that matches a Candidate’s profile and assessment result to a job vacancy posted by an Employer on the App and/or Website (collectively, “Our Service”). Thus, it is necessary and lawful for Collabrix to collect a User’s personal information to carry out our role and activity.
        • 3.1.1.1. Candidates: Information described in Clause 2.2 will be used to match the Candidate to potential job vacancies posted by Employers.
        • 3.1.1.2. Employers: Information specified in Clause 2.3 will be used to match job vacancies posted by Employers to Candidates.
      • 3.1.2. Generally: We use the Information to provide our Services to you including, but not limited to, enhancing the operation of the Site, improving our marketing and promotional efforts. We may also use the Information to troubleshoot, resolve disputes, accomplish administrative tasks, contact you, enforce our agreements with you, including our Site Terms of Service and this Policy, comply with applicable law, and cooperate with law enforcement activities.
      • 3.1.3. Contractors, Service Providers and Third-Parties:
        • 3.1.3.1. We may outsource some business functions to third-party vendors and service providers to carry out services related to the Aaitra App.
        • 3.1.3.2. In this regard, we may need to share Your Information with them to meet our contractual obligations.
        • 3.1.3.3. We share Your Information with these vendors and service providers through confidentiality agreements to keep Your Information confidential and authorise them to use it only for the purposes for which we disclose it to them.
        • 3.1.3.4. These third-party vendors and service providers will have their own terms and conditions as well as privacy policies and You are encouraged to read the same. Collabrix does not guarantee that these third-party vendors and service providers follow the same level of data protection and/or compliance with the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011.
        • 3.1.3.5. In the event there is a leakage of data or information by a third-party vendor or service provider, Collabrix shall not be liable for any loss or damage or otherwise.
      • 3.1.4. Heirs, Assigns, Subsidiaries: We may disclose your Information to our Heirs, Assigns, Subsidiaries and affiliates for the purpose of improving our Services. As mentioned before, disclosure to these parties will be made under confidentiality obligations.
      • 3.1.5. For any other purpose disclosed by us when you provide information to us.
      • 3.1.6. Legal Purposes: We may share your Information when we believe that such sharing is bona-fide and reasonably necessary to investigate, prevent, or take action regarding possible illegal activities or to comply with legal process. We may also share your Information to investigate and address threats or potential threats to the physical safety of any person, to investigate and address violations of this Privacy Policy or the Terms of Service, or to investigate and address violations of the rights of third parties and/or to protect the rights, property and safety of the Company, our employees, users, or the public. This may involve the sharing of your information with law enforcement, government agencies, courts, and/or other organizations on account of legal request such as subpoena, court order or government demand to comply with the law.
      • 3.1.7. Changes: We may also use your Information to inform you of any changes to the Site or Service, or to send you additional information about our Company.We may share your Information in any other circumstances where we have your consent.
    • 3.2. Non-personal information
      • 3.2.1. We may use Non-Personal Information to enhance the operation of Our Services, improve our marketing and promotional efforts, analyse site use, improve our product and service offerings, and tailor your experience with third parties consistent with this Policy and the Terms of Service. This Privacy Policy does not limit in any way our use or disclosure of Non-Personal Information and we reserve the right to use and disclose such Non-Personal Information to our partners, advertisers and other third parties at our discretion
  4. 4. Business transfer/ Corporate Restructuring
    • 4.1. Collabrix may sell, transfer or otherwise share some or all of its assets, including your Information, in connection with a merger, acquisition, reorganization, or sale of assets or in the event of bankruptcy or liquidation. The Privacy Policy of the resulting company would govern the use of that information. In the event of such business transfer or restructuring, your information will be safeguarded by adequate confidentiality provisions.

    • 5.1. You may update your own information shared with us from your account on Our Services. Unfortunately, we do not maintain any procedures for you to review or request changes to the information we collect about you during your use of Our Services. However, because we keep a record of all transactions, you cannot delete information associated with past transactions on the Site or by using the Service. Additionally, copies of data may temporarily retain information about users as a regular course of Company’s data protection and disaster prevention and recovery practices.

    • 6.1. Information collected by Us is stored securely and is not available to the public. Our employees are required by us to maintain and uphold your privacy and security and are aware of our privacy and security policies. Unfortunately, no data transmission over the Internet can be guaranteed 100% secure. As a result, while we strive to protect your personal information and have taken our best efforts to protect the same, we cannot ensure or warrant the security of any information you transmit to us, and you do so at your own risk. Collabrix cannot accept responsibility for any unauthorized access or loss of personal information that is beyond our control.
  7. 7. Your rights regarding the use of Your Personal Information
    • 7.1. You can prevent Us from contacting you for marketing/promotional purposes. When we send promotional communication to a User, the User can opt out of further promotional communications by following the unsubscribe instructions provided in such communication.
    • 7.2. Please note that notwithstanding the promotional preferences you indicate by either unsubscribing, we may continue to send you administrative emails including, for example, periodic updates to our Privacy Policy.
  8. 8. Links to other websites
    • 8.1. As part of Our Services, we may provide links to or compatibility with other third party websites or applications. However, we are not responsible for the privacy and data-protection practices employed by those websites or the information or content they contain. This Privacy Policy applies solely to information collected by Us through Our Services. Therefore, this Privacy Policy does not apply to your use of a third party website accessed by selecting a link on our Site or via our Services.
    • 8.2. To the extent that you access or use the Services through or on another website or application, then the privacy policy of that other website or application will apply to your access or use of that site or application. We encourage our users to read the privacy statements of other websites before proceeding to use them. In no event shall Collabrix be liable for any loss or damage in the event there is a breach of Your Information by third parties.

    • 9.2. As is true of most websites and mobile applications, Collabrix gathers some information automatically and stores it in log files. This information includes IP address, browser type and language, Internet service provider (ISP), referring and exit pages, operating system, date/time stamp, and clickstream data. We use this information to understand and analyze trends, to administer the site, to learn about user behavior on the site, to gather demographic information about our user base as a whole, and to measure the effectiveness of our customer communications. We may use this information in our marketing and advertising services.
    • 9.3. We may also collect information about when or whether you open our emails or promotional materials, and may use “click through URLs,” linked to particular content on the Service. We use this information to assess customer interest in particular topics and the success of our marketing and promotional efforts. If you prefer not to be tracked in this way, please do not click on any text or graphic links in our email messages.
  10. 10. No liability for acts of Third Parties
    • 10.1. Although we will use reasonable efforts to safeguard the confidentiality of your personal information, transmissions made by means of the Internet cannot be made absolutely secure. We will have no liability for any disclosure of information or unauthorized acts of third parties.
    • 10.2. To the extent permissible by law, Collabrix shall not be liable for any incidental, consequential or punitive damages relating to any alleged violation of this Privacy Policy, and Collabrix’s total liability for such alleged violation shall be any payments made by you to Collabrix for your use of the service (i.e., payments for our mobile application, if applicable).
    • 10.3. Your Information will be retained by us only no longer than required for the purposes for which the information may lawfully be used or is otherwise required under any other law for the time being in force.
    • 10.4. Collabrix shall not be responsible for the authenticity of the Information supplied by the User.
  11. 11. Changes in the Privacy Policy
    • 11.1. Collabrix reserves the rights to modify its Privacy Policy at any time and will notify you by posting an amendment to the Privacy Policy on the Service. If you do not agree with any such modifications, your sole remedy is to terminate your Account and to cease using the Service. Any modifications to this Privacy Policy will be effective as to you upon Collabrix posting the new Privacy Policy and/or implementation of any changes on the Service. You agree to review this Privacy Policy periodically so that you are aware of any modifications.
